Key finding ~ Selective non-disclosure

  • Apple markets itself carefully. Its sustainability communications are polished and optimistic.

  • In August 2024, a Frankfurt Regional Court ordered Apple to stop claiming carbon neutrality for Apple Watch. The offset project backing that claim was ruled ineffective.

  • Apple filed its sustainability report in April 2025. It filed its 10-K in October 2025. The Frankfurt ruling predates both. Neither document mentions it.

    • This isn't an oversight. Legal proceedings sections exist specifically to disclose material rulings. Apple chose not to use it.

  • The ECTF's Omission of Material Controversies indicator flags exactly this: a regulatory finding at court level, confirmed in the public record, absent from every official communication. Apple didn't lose a court case and forget to mention it. Apple lost a court case about a carbon neutrality claim and continued publishing carbon neutrality claims.

    • As a result, Apple’s communications are selective.
