Apple markets itself carefully. Its sustainability communications are polished and optimistic.
In August 2024, a Frankfurt Regional Court ordered Apple to stop claiming carbon neutrality for Apple Watch. The offset project backing that claim was ruled ineffective.
Apple filed its sustainability report in April 2025. It filed its 10-K in October 2025. The Frankfurt ruling predates both. Neither document mentions it.
This isn't an oversight. Legal proceedings sections exist specifically to disclose material rulings. Apple chose not to use it.
The ECTF's Omission of Material Controversies indicator flags exactly this: a regulatory finding at court level, confirmed in the public record, absent from every official communication. Apple didn't lose a court case and forget to mention it. Apple lost a court case about a carbon neutrality claim and continued publishing carbon neutrality claims.
As a result, Apple’s communications are selective.
